Welcome to Defakes.com (the "Platform"), provided by DeFakes Inc. ("we," "us," or "our").

These Terms of Service ("Terms") constitute a legally binding agreement between you and us governing your access to and use of the Defakes.com website, our Telegram Mini App, our mobile applications, and our forensic analysis services (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICES (OR BY CLICKING "LOGIN" / "CONNECT WALLET"), YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 12) THAT WAIVES YOUR RIGHT TO SUE IN COURT OR PARTICIPATE IN A CLASS ACTION.

1. The Nature of Our Services (AI Disclaimer)

1.1 Probabilistic Analysis, Not Definitive Proof.

The Services utilize Artificial Intelligence (AI), machine learning models, and community consensus to analyze digital media. You acknowledge that AI is probabilistic by nature. We do not guarantee the accuracy, reliability, or correctness of any analysis, verdict, or "Truth Score." A video flagged as "Fake" may be real, and vice versa (False Positives/Negatives).

1.2 No Legal or Professional Advice.

The content, Evidence Reports, and analysis provided by the Services are for informational purposes only. They do not constitute legal, forensic, or expert witness advice. You should not rely on our Services as the sole basis for legal disputes, financial decisions, or reputation management.

1.3 Technical vs. Contextual Authenticity.

Our "Real" verdict means the file shows no evidence of digital manipulation (AI generation or editing). It does not certify that the event depicted actually happened. A video may be "technically real" (no deepfake) but "contextually fake" (staged by actors). We are not liable for staged events, pranks, or acting performances that pass our forensic checks.

2. Eligibility and Account Access

2.1 Age Restrictions.

General Use (13+): You must be at least 13 years old to use the Services. If you are between 13 and the age of majority in your jurisdiction, you represent that your legal guardian has reviewed and agreed to these Terms.

Restricted Features (18+): You must be at least 18 years old to access specific features, including but not limited to: purchasing Points, initiating financial transactions, accessing wagering/staking modules (where available), or requesting professional legal/investigative services.

2.2 Accounts & Telegram Integration.

To access certain features, you may need to authenticate via a third-party provider (e.g., Telegram). You are responsible for maintaining the security of your third-party accounts. We are not liable for any loss resulting from unauthorized access to your linked accounts.

3. The Dual-Currency Economy & Scoring Logic

3.1 Points (Utility Credits & Discount Redemption).

"Points" are a virtual utility currency used solely to access platform features.

  • No Cash Value: Points cannot be exchanged for cash, cryptocurrency, or withdrawn to a bank account.
  • Redemption Cap: Points may be redeemed for discounts on Professional Services at a rate determined by us. The maximum discount redeemable per transaction is capped at 20% of the Service price or $10.00 USD, whichever is lower. You cannot purchase Professional Services entirely with Points.
  • Verification Requirement: We reserve the right to require biometric verification (e.g., Face ID / Liveness Check) before allowing any point redemption to prevent bot abuse.

3.2 Reputation XP (Status).

"Case XP" or "Detective Rank" is a non-purchasable metric representing your accuracy and participation. It is used for leaderboard ranking and consensus weighting. It has no monetary value.

3.3 Skill-Based Interactions (Not Gambling).

In features involving "Staking" or "Predictions," rewards are distributed based on Scientific Accuracy and Forensic Consensus, not chance. Outcomes are determined by verified forensic data, not dice rolls or RNG.

3.4 Scoring Finality and "Match" Logic.

You acknowledge that gameplay rewards (XP, Points, "Matches") are awarded solely for aligning with the System's initial determination at the time of the event.

The "Match" Standard: A "Win" is defined strictly as an agreement between your vote and the AI Model's probabilistic output (or the Community Consensus) at the moment of reveal. It is not a warranty of objective truth.

Finality of Results: All scoring, rankings, and point distributions are final and irreversible the moment they are recorded. Even if a subsequent "Deep Scan" or expert review later contradicts the initial verdict, previously awarded points or game results will not be reversed or refunded to the user.

3.5 Right to Correct Errors and Clawback.

We reserve the right, at our sole discretion, to modify, zero-out, or "claw back" any Points, XP, or Rewards if we determine that they were acquired through:

  • System Error: A bug, glitch, or "manifest error" in the AI scoring model.
  • Manipulation: Use of bots, scripts, exploits, or multiple accounts to farm rewards.
  • Critical Failures: We reserve the specific right to revoke points granted for a verdict that is later deemed a manipulated event.

No Property Right: You acknowledge that Earned Points have no cash value, and their removal by us does not constitute a loss of property or money.

4. User Content and Conduct

4.1 Ownership & License.

You retain ownership of the media you upload. However, to provide and maintain the Service, you grant us a worldwide, royalty-free license to use, host, store, reproduce, modify, and analyze your content for the limited purposes of operating, securing, and improving the Services, developing new features, and conducting internal quality assurance.

4.2 Prohibited Conduct.

You agree not to use the Services to:

  • Upload illegal content (e.g., CSAM, non-consensual intimate imagery).
  • Create or refine deepfakes for malicious purposes.
  • Harass, bully, or defame others using our forensic verdicts.
  • Manipulate the voting system via bots, scripts, or coordinated attacks (Sybil attacks).

5. Intellectual Property Rights

The Services, including our AI models, the "Defakes" brand, the "Truth Card" format, the waterfall routing logic, and the UI/UX, are owned by us and protected by copyright, trademark, and patent laws (Patent Pending). You may not reverse engineer, decompile, or copy our underlying code or algorithms.

6. Purchases and Refunds

6.1 Final Sale.

All purchases of Points or Services are final and non-refundable. We do not offer refunds for unused points or dissatisfaction with the service.

6.2 No Refunds for AI Errors.

You expressly agree that no refunds or credits will be issued due to an "incorrect" AI verdict, a disputed consensus result, or a False Positive/Negative analysis. You are purchasing the access to the tool, not a guarantee of a specific outcome.

6.3 No Monetary Value.

Points and XP are virtual game units with no real-world monetary value. They cannot be exchanged for cash, crypto, or interest. If your account is suspended for suspicious activity, your Point balance may be immediately forfeited.

6.4 Fair Use Policy (Web & Mobile App).

"Unlimited" scan privileges included in Consumer and Professional Packages are intended for individual human use via our provided user interface. To maintain service quality, these accounts are subject to a Fair Use Policy of 50 scans per day.

6.5 Enterprise & API Exception.

The limits in Section 6.4 do not apply to accounts operating under a separate Enterprise Master Services Agreement (MSA) or authorized API Access Plan. High-volume commercial usage (e.g., automated insurance claims processing, platform moderation) requires an Enterprise Agreement. Attempting to run high-volume automated scans via a standard Consumer account is a violation of these Terms and may result in immediate suspension.

7. Third-Party Links and App Stores

7.1 App Store Terms.

If you access the Services via the Apple App Store or Google Play Store, you agree to comply with their respective Usage Rules. These Terms are between you and us, not with Apple or Google.

7.2 External Links.

Our Service may contain links to third-party websites or services (e.g., blockchain explorers, payment processors). We are not responsible for the content or practices of these third parties.

8. Disclaimers and Assumption of Risk

THE SERVICES ARE PROVIDED "AS IS." WE DO NOT WARRANT THAT THE AI ANALYSIS IS ACCURATE.

AI Limitations: You acknowledge that generative AI is a rapidly evolving field. Our models may produce "False Positives" or "False Negatives."

Assumption of Risk: By using the Service, you voluntarily assume the risk that the Analysis Results may be incorrect. You agree that Defakes.com is not liable for any reputational damage, financial loss, or distress caused by an incorrect Real/Fake verdict.

No Reliance: You agree not to use our "Quick Check" results as the primary evidence in legal proceedings, employment decisions, or public accusations.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEFAKES.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR REPUTATION, ARISING FROM:

  • (A) YOUR USE OF OR INABILITY TO USE THE SERVICE;
  • (B) ANY FORENSIC VERDICT (CORRECT OR INCORRECT) PRODUCED BY THE SERVICE;
  • (C) ANY CONDUCT OF THIRD PARTIES ON THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR (II) $100 USD.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, disputes, liabilities, damages, and costs arising out of: (i) your access to or use of the Services, (ii) your User Content, or (iii) your violation of these Terms.

11. Data Privacy and Blockchain

11.1 Privacy Policy.

Your use of the Services is also governed by our Privacy Policy.

11.2 Blockchain and Data Deletion (The "Receipt" vs. The "Content").

You acknowledge that our integrity system works by separating the "Source Media" (the file) from the "Integrity Record" (the hash).

Deletable Data: We store the Source Media on centralized databases. If you delete your account, we permanently delete the Source Media (subject to legal retention).

Immutable Hash: The cryptographic hash may be anchored on a public blockchain. You understand that this hash is permanent and cannot be deleted. However, once we delete the Source Media, the hash becomes a "detached fingerprint" that creates no visual reconstruction of your original content.

12. Dispute Resolution (Arbitration)

12.1 Binding Arbitration.

Any dispute arising from these Terms will be settled by binding arbitration in the State of Delaware, and not in a court of law.

12.2 Class Action Waiver.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
